I. Allgemeines

(1) Nachfolgend informieren wir Sie über die Erhebung personenbezogener Daten bei der Nutzung unserer Internetseite.

(2) Der Begriff 'personenbezogene Daten' meint unter Verweis auf die Definition des Art. 4 Nr. 1 der Verordnung (EU) 2016/679 (nachfolgend bezeichnet als 'Datenschutz-Grundverordnung' bzw. kurz 'DSGVO') alle Daten, die auf Sie persönlich beziehbar sind. Darunter fallen beispielsweise Name, Adresse, E-Mail-Adresse, Nutzerverhalten. Hinsichtlich weiterer Begrifflichkeiten, insbesondere der Begriffe 'Verarbeitung', 'Verantwortlicher', 'Auftragsverarbeiter' und 'Einwilligung', verweisen wir auf die gesetzlichen datenschutzrechtlichen Definitionen des Art. 4 DSGVO.

(3) Wir verarbeiten personenbezogene Daten grundsätzlich nur, soweit dies zur Bereitstellung einer funktionsfähigen Webseite sowie der von uns angebotenen Inhalte und Leistungen erforderlich ist. Die Verarbeitung personenbezogener Daten erfolgt regelmäßig nur dann, wenn Sie uns eine Einwilligung im Sinne des Art. 6 Abs. 1 lit. a) DSGVO erteilt haben oder die Verarbeitung durch gesetzliche Vorschriften, insbesondere durch eine der in Art. 6 Abs. 1 lit. b) bis lit. f) DSGVO genannten Rechtsgrundlagen, gestattet ist.

(4) Ihre personenbezogenen Daten werden gelöscht oder gesperrt, sobald der Zweck der Speicherung entfällt. Eine Speicherung kann darüber hinaus dann erfolgen, wenn dies durch nationale oder europäische Vorschriften, denen wir unterliegen, vorgesehen wurde. Eine Sperrung oder Löschung der Daten erfolgt in diesem Fall dann, wenn die in den jeweiligen Vorschriften vorgeschriebene Speicherfrist abgelaufen ist. Letzteres gilt dann nicht, wenn eine weitere Speicherung der Daten für einen Vertragsabschluss oder eine Vertragserfüllung erforderlich ist.

(5) Soweit wir für einzelne Funktionen unserer Webseite auf beauftragte Dienstleister zurückgreifen oder Ihre Daten für werbliche Zwecke nutzen möchten, werden wir Sie untenstehend im Detail über die jeweiligen Vorgänge informieren.

IV. Ihre Rechte

(1) Sie haben uns gegenüber hinsichtlich der Sie betreffenden personenbezogenen Daten die nachfolgenden Rechte:

  • das Recht auf Auskunft,
  • das Recht auf Berichtigung und Löschung,
  • das Recht auf Einschränkung der Verarbeitung,
  • das Recht auf Widerspruch gegen die Verarbeitung,
  • das Recht auf Datenübertragbarkeit.

(2) Sie haben zusätzlich das Recht, sich bei einer Datenschutz-Aufsichtsbehörde über die Verarbeitung Ihrer personenbezogenen Daten durch uns zu beschweren.

V. Verarbeitung personenbezogener Daten bei informatorischer Nutzung unserer Webseite

(1) Wenn Sie unsere Webseite aufrufen, ohne sich dabei zu registrieren oder uns auf andere Weise Informationen zukommen zu lassen ('Informatorische Nutzung'), erheben wir nur diejenigen personenbezogenen Daten, die Ihr Webbrowser an unseren Server übermittelt. Wenn Sie unsere Webseite betrachten möchten, erheben wir die folgenden Daten, die für uns technisch erforderlich sind, um Ihnen die Anzeige unserer Webseite zu ermöglichen und die Stabilität und Sicherheit zu gewährleisten: IP-Adresse, Datum und Uhrzeit der Anfrage, Zeitzonendifferenz zu GMT, Inhalt der Webseite, Zugriffsstatus (HTTP-Status), übertragene Datenmenge, Anforderungs-Website, Webbrowser, Betriebssystem, Sprache und Version des Browsers

(2) Die vorgenannten Daten werden ebenfalls in sog. Logfiles auf unseren Servern gespeichert. Eine Speicherung dieser Daten zusammen mit anderen personenbezogenen Daten von Ihnen findet nicht statt.

(3) Die Erhebung und vorübergehende Speicherung der IP-Adresse ist notwendig, um die Auslieferung unserer Webseite auf Ihr Endgerät zu ermöglichen. Hierfür muss Ihre IP-Adresse für die Dauer des Besuchs unserer Webseite gespeichert werden.

(4) Die Speicherung der oben genannten Daten in Logfiles dient der Sicherstellung der Funktionsfähigkeit und zur Optimierung unserer Webseite sowie zur Sicherstellung der Sicherheit unserer informationstechnischen Systeme.

(5) Eine Auswertung dieser Daten zu Marketingzwecken findet nicht statt. In den vorstehenden Zwecken liegt unser berechtigtes Interesse an der Datenverarbeitung. Rechtsgrundlage für die Erhebung und die vorübergehende Speicherung der vorgenannten Daten und der Logfiles ist Art. 6 Abs. 1 S. 1 lit. f) DSGVO. Die vorstehenden Daten zur Bereitstellung unserer Website werden gelöscht, wenn die jeweilige Sitzung beendet ist. Die Erhebung der vorstehenden Daten zur Bereitstellung unserer Webseite und die Speicherung dieser Daten in Logfiles ist für den Betrieb unserer Website zwingend erforderlich. Es besteht keine Widerspruchsmöglichkeit.

VI. Weitere Funktionen und Angebote unserer Webseite

(1) Neben der vorbeschriebenen informatorischen Nutzung unserer Webseite bieten wir verschiedene Leistungen an, die Sie bei Interesse nutzen können. Hierfür ist in der Regel die Angabe weiterer personenbezogener Daten notwendig. Diese Daten benötigen wir zur Erbringung der jeweiligen Leistung. Es gelten hierfür die vorstehenden Grundsätze zur Datenverarbeitung.

(2) Zum Teil greifen wir zur Verarbeitung dieser Daten auf externe Dienstleister zurück, die von uns sorgfältig ausgewählt und beauftragt wurden. Diese Dienstleister sind an unsere Weisungen gebunden und werden regelmäßig von uns kontrolliert. Soweit personenbezogene Daten im Zuge von Leistungen, die wir gemeinsam mit Partnern anbieten, an Dritte weitergegeben werden, können Sie nähere Informationen den nachfolgenden Beschreibungen der einzelnen Leistungen entnehmen. Soweit diese Dritten ihren Sitz in einem Staat außerhalb des Europäischen Wirtschaftsraumes haben, können Sie nähere Informationen über die Folgen dieses Umstands in den nachfolgenden Beschreibungen der einzelnen Leistungen entnehmen.

VII. Kontaktaufnahme

(1) Wenn Sie mit uns per E-Mail Kontakt aufnehmen, werden die von Ihnen an uns mit Ihrer E-Mail übermittelten personenbezogenen Daten gespeichert.

(2) Die Daten werden ausschließlich zur Beantwortung Ihrer Fragen verwendet. Soweit dies nicht explizit in dieser Datenschutzerklärung angegeben ist, erfolgt keine Weitergabe der Daten an Dritte. Zusätzlich erfassen wir Ihre IP-Adresse und den Zeitpunkt der Absendung.

(3) Die Verarbeitung der vorstehenden personenbezogenen Daten dient allein zur Bearbeitung Ihrer Anfragen.

(4) Hierin liegt auch unser berechtigtes Interesse an der Verarbeitung Ihrer personenbezogenen Daten. Soweit Sie uns hierfür eine Einwilligung erteilt haben, ist Rechtsgrundlage für die Verarbeitung dieser Daten Art. 6 Abs. 1 lit. a) DSGVO. Im Übrigen ist Rechtsgrundlage für die Verarbeitung dieser Daten Art. 6 Abs. 1 lit. f) DSGVO, insbesondere für den Fall, dass uns die Daten von Ihnen durch Übersendung einer E-Mail übermittelt werden. Soweit Sie durch Ihre E-Mail auf den Abschluss eines Vertrages hinwirken wollen, stellt Art. 6 Abs. 1 lit. b) DSGVO eine zusätzliche Rechtsgrundlage dar.

(5) Die Daten werden vorbehaltlich gesetzlicher Aufbewahrungsfristen gelöscht, sobald wir Ihre Anfrage abschließend bearbeitet haben. Bei einer Kontaktaufnahme per E-Mail können Sie der Speicherung Ihrer personenbezogenen Daten jederzeit widersprechen. Wir weisen Sie darauf hin, dass in diesem Fall Ihre Anfrage nicht weiterbearbeitet werden kann. Den Widerruf oder den Widerspruch können Sie durch Übersendung einer E-Mail an unsere im Impressum angegebene E-Mail-Adresse erklären.

VIII. Registrierung

(1) Um zusätzliche Funktionen unseres Internetauftritts zu nutzen, bieten wir die Möglichkeit, sich unter Angabe personenbezogener Daten zu registrieren. Die Daten werden dabei in eine Eingabemaske eingegeben und an uns übermittelt und gespeichert. Eine Weitergabe der Daten an Dritte findet nicht statt. Die bei der Registrierung abgefragten Pflichtangaben sind entsprechend gekennzeichnet und müssen vollständig angegeben werden. Anderenfalls werden wir die Registrierung ablehnen. Folgende Daten werden im Rahmen des Registrierungsprozesses erhoben: Anrede, Vorname, Name, E-Mailadresse, Telefon, Benutzer, Passwort.

(2) Im Zeitpunkt der Registrierung werden zudem die IP-Adresse und Datum und Uhrzeit der Registrierung gespeichert. Im Rahmen des Registrierungsprozesses wird eine Einwilligung des Nutzers zur Verarbeitung dieser Daten eingeholt.

(3) Eine Registrierung ist für das Bereithalten bestimmter Inhalte und Leistungen auf unserer Website erforderlich. Die dazu eingegebenen Daten verwenden wir nur zum Zwecke der Nutzung des jeweiligen Angebotes oder Dienstes oder zur Bereitstellung der Leistungen, für deren Inanspruchnahme Sie sich registriert haben. Im Falle wichtiger Änderungen unsere Angebote, Dienste oder Leistungen, etwa betreffend den Angebotsumfang oder bei technisch notwendigen Änderungen nutzen wir die bei der Registrierung angegebene E-Mail-Adresse, um Sie hierüber zu informieren. Rechtsgrundlage für die Verarbeitung der Daten ist Art. 6 Abs. 1 S. 1 lit. a) DSGVO. Soweit die Registrierung zum Abschluss oder der Durchführung eines Vertrages dient, stellt Art. 6 Abs. 1 S. 1 lit. b) DSGVO eine zusätzliche Rechtsgrundlage dar.

(4) Eine von Ihnen erteilte Einwilligung können Sie jederzeit widerrufen. Die Rechtmäßigkeit der bereits erfolgten Datenverarbeitung bleibt vom Widerruf unberührt.

(5) Die Daten werden gelöscht, sobald sie für die Erreichung des Zweckes ihrer Erhebung nicht mehr erforderlich sind. Dies ist der Fall, wenn die Registrierung auf unserer Internetseite aufgehoben oder abgeändert wird. Sie haben jederzeit die Möglichkeit, die Registrierung aufzulösen. Die über Sie gespeicherten Daten können Sie jederzeit abändern lassen. Gesetzliche Aufbewahrungsfristen bleiben unberührt.

(6) Wir übermitteln personenbezogene Daten nur dann an Dritte, wenn dies im Rahmen der Vertragsabwicklung notwendig ist. Eine weitergehende Übermittlung der Daten erfolgt nicht bzw. nur dann, wenn Sie der Übermittlung ausdrücklich zugestimmt haben. Eine Weitergabe Ihrer Daten an Dritte ohne ausdrückliche Einwilligung, etwa zu Zwecken der Werbung, erfolgt nicht.

(7) Soweit Sie uns eine Einwilligung erteilt haben, ist Rechtsgrundlage für die Verarbeitung der Daten Art. 6 Abs. 1 S. 1 lit. a) DSGVO. Im Übrigen ist Rechtsgrundlage Art. 6 Abs. 1 S. 1 lit. b) DSGVO.

IX. MyFonts Counter

Wir setzen den Dienst auf unserer Website ein.

Der Dienst speichert und verarbeitet Informationen über Ihr Nutzerverhalten auf unserem Internetauftritt. Hierfür verwendet der Dienst unter anderem Cookies, also kleine Textdateien, die lokal im Zwischenspeicher Ihres Webbrowsers auf Ihrem Endgerät gespeichert werden und die eine Analyse der Benutzung unseres Internetauftritts durch Sie ermöglichen.

Wir verwenden den Dienst, um die Nutzung unserer Webseite analysieren und einzelne Funktionen und Angebote sowie das Nutzungserlebnis fortlaufend verbessern zu können. Durch die statistische Auswertung des Nutzerverhaltens können wir unser Angebot verbessern und für Sie als Nutzer interessanter ausgestalten. Die Daten werden gelöscht, sobald sie für die Erreichung des Zweckes ihrer Erhebung nicht mehr erforderlich sind.

(1) The information below tells you about the collection of personal data when you access our website.

(2) The term “personal data” as defined in Art. 4 no. 1 of Regulation (EU) 2016/679 (referred to below as “General Data Protection Regulation” or “GDPR”) means all data which relate to you personally. For other terms, in particular “processing”, “controller”, “processor” and “consent”, please refer to the legal data protection definitions in Art. 4 GDPR.

(3) In principle, we will only process personal data if this is necessary in order to provide a functioning website and the content and services we offer. Personal data will normally only be processed if you have given us consent within the meaning of point (a) of Art. 6(1) GDPR or processing is allowed under statutory provisions, in particular on one of the legal grounds set out in points (b) to (f) of Art. 6(1) GDPR.

(4) Your personal data will be erased or blocked as soon as the purpose of storage no longer applies. They may be stored for longer if this has been provided for in national or European regulations to which we are subject. In this case the data will be erased or blocked when the storage period required under the respective regulations expires. The latter does not apply if continued storage of the data is required for the purposes of entering into or performing a contract.

(5) If we engage service providers to perform particular functions of our website or wish to use your data for advertising purposes, we will inform you in detail below of the relevant processes.

(1) You have the following rights regarding the personal data concerning you that we hold:

  • the right of access,
  • the right to rectification and erasure,
  • the right to restrict processing,
  • the right to object to processing,
  • the right to data portability.

(2) You also have the right to lodge a complaint with a data protection supervisory authority about our processing of your personal data.

Processing of personal data when our website is used for informational purposes

(1) If you access our website without registering or otherwise providing us with information (“informational use”), we will only collect the personal data that your browser sends to our server. If you want to view our website, we will collect the following data that we need for technical reasons in order to enable us to display our website and ensure its stability and security: IP address, date and time of the request, time zone difference from GMT, content of the web page, access status (HTTP status), data volume transferred, requesting website, web browser, operating system, language and version of the browser.

(2) The above data will also be stored on our servers in what are known as log files. These data will not be stored together with other personal data concerning you.

(3) The collection and temporary storage of the IP address are necessary in order to enable us to deliver our website to your device. This requires us to store your IP address for the duration of your visit to our website.

(4) The above data are stored in log files in order to ensure the functionality and optimization of our website and the security of our information technology systems.

(5) These data will not be analyzed for marketing purposes. In the above purposes we have a legitimate interest in the processing of these data. The legal basis for the collection and temporary storage of the above data and the log files is point (f) of Art. 6(1) GDPR. These data for the delivery of our website will be erased when the respective session ends. The collection of these data for the delivery of the website and the storage of these data in log files are absolutely essential for the operation of our website. You have no right to object.

Other functions and offerings of our website

(1) In addition to the above informational use of our website, we offer various services that you are able to use if interested. This generally requires you to provide further personal data. We need these data in order to perform the respective service. The above data processing principles apply.

(2) For the processing of these data we may make use of external service providers whom we have carefully selected and commissioned. These service providers are bound by our instructions and are monitored regularly by us. Where personal data are passed on to third parties for the purposes of services which we offer in conjunction with partners, please refer to the following descriptions of the individual services for more information. If these third parties are registered in a state outside the European Economic Area, please refer to the following descriptions of the individual services for more information about the consequences of this.

Making contact

(1) If you make contact with us by email, the personal data sent to us with your email will be stored.

(2) The data will be used solely in order to answer your questions. Unless explicitly stated in this Data Protection Statement, the data will not be passed on to third parties. We will also record your IP address and the time you sent the email.

(3) These personal data will be processed solely in order to respond to your inquiries.

(4) In this purpose we have a legitimate interest in the processing of your personal data. If you have given us your consent, the legal basis for the processing of these data is point (a) of Art. 6(1) GDPR. In other respects, the legal basis for the processing of these data is point (f) of Art. 6(1) GDPR, particularly for the case that you gave us the data when sending an email. If your email was sent for the purpose of entering into a contract, point (b) of Art. 6(1) GDPR provides an additional legal basis.

(5) Subject to statutory retention periods, the data will be erased as soon as we have finally dealt with your inquiry. If you made contact with us by email, you can object to the storage of your personal data at any time. Please note that in this case we will be unable to take your inquiry any further. You can state your objection or withdrawal of consent by sending an email to the email address indicated in the Legal Notice.

Registration

(1) To use additional functions of our website, we offer the option of registering by entering personal data. The data will be entered on an input template and sent to us for storage. The data will not be passed on to third parties. The mandatory information requested in the registration process is marked accordingly and must be provided in full, failing which we will reject registration. The following data will be collected in the registration process: title, first name, surname, email address, telephone, user, password.

(2) The IP address and the date and time of registration will also be stored when registering. The consent of the user to the processing of these data will be obtained in the registration process.

(3) Registration is required for the provision of certain content and services on our website. We will only use the data you enter for the purposes of the particular offering or function or the provision of the services for the use of which you registered. In the event of important changes to our offerings, functions or services, such as the scope of the offering or if there are technical modifications, we will use the email address you provided when registering in order to inform you of them. The legal basis for the processing of the data is point (a) of Art. 6(1) GDPR. If the registration was for the purposes of entering into or performing a contract, point (b) of Art. 6(1) GDPR provides an additional legal basis.

(4) You can at any time withdraw consent that you had given previously. Withdrawal does not affect the lawfulness of the data processing that has already occurred.

(5) The data will be erased as soon as they are no longer necessary for achievement of the purpose for which they were collected. This is the case if the registration on our website is canceled or modified. You can cancel registration at any time. You can also have the data stored about you modified at any time. This does not affect statutory retention periods.

(6) We will only transmit personal data to third parties if this is necessary for the purposes of fulfilling the contract. There will be no further transmission of the data unless you have expressly consented to such transmission. Your data will not be passed on to third parties, e.g. for the purposes of advertising, without your express consent.

(7) If you have given us consent, the legal basis for the processing of these data is point (a) of Art. 6(1) GDPR. In other respects, the legal basis is point (b) of Art. 6(1) GDPR.

Broker portal

The broker portal and its services can only be used with personal, password-protected access. The data you have stored can be viewed and managed within the account. If you use our portal, we will store the data required for performance of the contract, including where necessary details of the method of payment, until you finally erase your access. We will continue to store the data you provide voluntarily for as long as you use the portal unless you erase them beforehand. You can manage and edit all details in the protected customer area. The legal basis is points (a), (b) and (f) of Art. 6(1) GDPR.

Applications

You can send applications to us by electronic means (email). We will of course only use your details in order to deal with your application and will not pass them on to third parties. Please note that emails sent in unencrypted form will not be protected from access by third parties. If you have applied for a particular position and this has already been filled or we believe you are just as or even more suitable for a different position, we would like to forward your application within the company. Please let us know if you do not consent to such forwarding. Your personal data will be erased as soon as the application process ends, but not later than after 6 months, unless you have expressly given your consent to the storage of your data for longer or a contract has come about. The legal basis is points (a), (b) and (f) of Art. 6(1) GDPR and section 26 of the German Data Protection Act (BDSG).

Data transmission

Your data will not in principle be transmitted to third parties unless we have a statutory obligation to do so or the forwarding of data is necessary in order to fulfill the contractual relationship, or you have previously expressly given your consent to the forwarding of your data. To the extent that our service providers come into contact with your personal data, we will ensure through a data processing contract pursuant to Art. 28 GDPR that they comply with the provisions of data protection laws to the same extent.

Data security

We have taken extensive technical and operational precautions to protect your data from accidental or intentional manipulation, loss, destruction or access by unauthorized persons. Our security procedures are reviewed regularly and adapted in the light of technological progress.
